Senate Dems To Blago: Call Off The Appointment, We Will Not Seat Burris
The Senate Democratic leadership has now released a statement on the impending appointment of Roland Burris to Barack Obama's Senate seat, expressing their very strong displeasure at the situation and making it clear that they will not accept his appointment:
We say this without prejudice toward Roland Burris's ability, and we respect his years of public service. But this is not about Mr. Burris; it is about the integrity of a governor accused of attempting to sell this United States Senate seat. Under these circumstances, anyone appointed by Gov. Blagojevich cannot be an effective representative of the people of Illinois and, as we have said, will not be seated by the Democratic Caucus.
The statement then goes on to say that the appointment is unfair to Burris and unfair to Illinois, and calls upon Blagojevich to not make this appointment, and to instead step down and let Democratic Lt. Gov. Pat Quinn make the appointment instead.

SENATE DEMOCRATIC LEADERSHIP STATEMENT ON GOV. BLAGOJEVICH'S APPOINTMENT OF ROLAND BURRIS TO THE VACANT U.S. SENATE SEAT FROM ILLINOIS
Washington, DC -- Senate Democratic Leadership made the following statement today in response to reports that Illinois Governor Rod Blagojevich will nominate Roland Burris to fill the vacant Illinois Senate seat. Earlier this month, all 50 members of the Senate Democratic Caucus called on Blagojevich to step down and under no circumstance make an appointment to fill the seat. The text of that letter is below the statement:
"It is truly regrettable that despite requests from all 50 Democratic Senators and public officials throughout Illinois, Gov. Blagojevich would take the imprudent step of appointing someone to the United States Senate who would serve under a shadow and be plagued by questions of impropriety. We say this without prejudice toward Roland Burris's ability, and we respect his years of public service. But this is not about Mr. Burris; it is about the integrity of a governor accused of attempting to sell this United States Senate seat. Under these circumstances, anyone appointed by Gov. Blagojevich cannot be an effective representative of the people of Illinois and, as we have said, will not be seated by the Democratic Caucus.
"Next week we will start one of the most important debates of the year - outlining an economic recovery plan to create jobs and invest in America. And in the coming weeks, we will be working to protect homeowners and consumers, make America more energy independent, strengthen our national security, and improve health care and educational opportunities. There is much work to do and a lot at stake. It is thus critical that Illinois and every other state have two seated Senators without delay.
"We again urge Gov. Blagojevich to not make this appointment. It is unfair to Mr. Burris, it is unfair to the people of Illinois and it will ultimately not stand. The governor must put the interests of the people of Illinois and all Americans first by stepping aside now and letting his successor appoint someone who we will seat."

Dear Governor Blagojevich:
We write to insist that you step down as Governor of Illinois and under no circumstance make an appointment to fill the vacant Illinois Senate seat. In light of your arrest yesterday on alleged federal corruption charges related to that Senate seat, any appointment by you would raise serious questions.
It is within the authority of the Illinois legislature to remove your power to make this appointment by providing for a special election. But a decision by you to resign or to step aside under Article V of the Illinois Constitution would be the most expeditious way for a new Senator to be chosen and seated in a manner that would earn the confidence of the people of Illinois and all Americans. We consider it imperative that a new senator be seated as soon as possible so that Illinois is fully represented in the Senate as the important work of the 111th Congress moves forward.
Please understand that should you decide to ignore the request of the Senate Democratic Caucus and make an appointment we would be forced to exercise our Constitutional authority under Article I, Section 5, to determine whether such a person should be seated.
We do not prejudge the outcome of the criminal charges against you or question your constitutional right to contest those charges. But for the good of the Senate and our nation, we implore you to refrain from making an appointment to the Senate.

The RACIST white democrats are trying to block the nations 4th black Senator in the nations history. They did not try to block Blagojevich's pardons, he issued 29 without a hint of the dems. trying overturn them. All of a sudden when he nominates a black Senator, they are trying to overturn his decisions.

I think it is more about the fact that anyone Blago appoints will be viewed as tainted and easy prey for repubs to criticize.
Blago should have appointed a committee and included the Attorney General and some other dem elected officials from Illinois and had them select the person that he could then appoint.
It looks like Senate Dems could lose this fight in court if it went that far according to the info on the front page of TPM.
Blago's a jackass, what did he think would happen?

1. Blago pardoned people in Illinois. How on earth would the US Senate attempt to block those?
2. Reid and the 50 Senate Democrats issued a statement on 12/10 saying that they would not seat ANYBODY appointed by Blago. Now, that Blago has appointed Burris, it suddenly becomes about race?

the democrats in Ill. did not try to overturn the pardons Blagojevich issued. By the way, it is UNCONSTITUTIONAL for Harry Reid to block a Senator appointed by a governor from serving in the US Senate. Sen. Harry Reid himself could be charged with a crime.

look, vafanculo, or whatever your name is, Reid couldn't be charged with a crime for voting against seating someone. That's ridiculous. They have more than a ministerial function in examining the qualifications. It's not just, yep, that seat was sold fair and square under the laws and institutions of the state of Illinois. The governor is on tape seeking a bribe for this seat. That does call into question the legality of his making the appointment. They have the right to look into it.

I guess what will happen is that Burris will be seated and then the entire Senate will have to vote him out with a 2/3 majority.
I don't see how they will block him from being initially seated but they CAN vote him out once he is seated although that has not been done since the Civil War.

Harry "Spineless" Reid, Chuck "Wall Street" Schumer, and Durbin who cowed to the Republicans and stood up in the Senate and offered a tearful apology for comparing our troop's abuse of prisoners to Nazis, etc.
Durbin's words were uncalled for, but to cave to the Republicans as he did was a frikkin disgrace.
If ever a party needed new leadership, this is it.

now this is just stupid. yes, Blago is a dyed-in-the-wool idiot and quite obviously a massive megalomaniac. but from what I can tell, Ill. is saying collectively that they don't have the $ for a special election, and Mr. Burris is, according to many familiar with Ill. politics, a fine appointment. would there be a cloud over him? not really. the cloud is over Blago, and I don't see any reason to apply some kind of transference powers to it.

Interesting that they say he will not be seated "by the Democratic Caucus." Does that mean he won't be seated as a US Senator, or he won't be accepted into the caucus?

Traditionally, each party's caucus acts on its own members. Recall that it was the Republican caucus that called on Stevens to resign. If the Democratic Caucus says Burris won't be seated, they have the votes to deny him and there is no court on earth to which he can appeal. The Constitution is pretty clear on giving each House sole authority.
The only question is whether they'll have the stones to actually do it. I'm betting Blago is figuring it would be politically impossible for the Senate to refuse to seat a black candidate, but with Obama publicly backing them, that neutralizes that aspect. This one is a long way from being over.
