When Is An Ad Starring A Candidate Not About The Candidate?

A new series of ads by the Oregon Democrats raises an interesting question: Is the state party trying to evade campaign finance rules by running so-called "issue ads" -- which ostensibly aren't supposed to be about the candidates -- that just so happen to star their nominee for Senate?

Since last week, the Oregon Dems have been running ads featuring Senate nominee Jeff Merkley, the state House speaker who is running against GOP Senator Gordon Smith. Here's one of them:

As you can see, this "issue" ad does showcase a candidate.

And since then, Smith's campaign has filed a complaint with the FEC, alleging that the Oregon Dems and Merkley are trying to circumvent campaign finance laws.

The response from Merkley and the Dems is rather intriguing: Even if the ads star a candidate, they aren't actually about the Senate race, nor do they reproduce his platform. And check out this quote:

"It's not a coordinated expenditure," Merkley spokesperson Matt Canter told Election Central. "It's an expenditure that's coordinated."

Canter elaborated by saying that Merkley is in the ads because of his work in the legislature, furthering bills on the issues that the party advocates. "The Democratic Party asked Jeff Merkley to participate in these ads because he's the natural spokesman on these issues that Democrats care about."

In an e-mail to Election Central, Smith spokesperson Lindsay Gilbride called that line of reasoning "laughable, ridiculous and illegal."

So what's the deal? Paul S. Ryan, associate legal counsel at the Washington-based Campaign Legal Center, said the key issue is whether the ads constitute the republication of Merkley's own campaign materials. If so, they would be subject to spending limits, which would mean the state Dems would have already broken the limit. Making this more ambiguous, these ads weren't run within 90 days of the election, when the rules are much more stringent, meaning that the Dems' explanation might just pass legal muster.

This guy would be perfect material for Dubya's press secretary.  Or maybe a speechwriter for Alberto Gonzales.

I remember making a small donation ($50?) to Merkeley via ActBlue.  I even got a nice hand-signed thank-you letter.  But I don't think I'll be throwing any cash that way anymore.

I read this in the paper a couple days ago and meant to link it up, but didn't get to it.

Somebody once said, "we've become a Nation of Whiners." Smith is pissed because he didn't think of it first.

This ad was not aired by the Merkley Campaign, it was an ad aired by the Democratic Party of Oregon. The Democratic Party of Oregon wanted to feature Jeff Merkley because he has been a leader on veterans issues in our state.

As House Speaker, Merkley passed a bill which funded college tuition for family members of the fallen. He also pushed through a bill that provided additional financial aid to veterans and passed a personal tax exemption to more National Guards members. Merkley also passed a bill creating incentives for employers to hire veterans. Merkley also passed tax incentives for health care providers who participate in the TRICARE program. Lastly, Merkley passed House Joint Memorial 9 which was a resolution urging the President to end the war.

Sarah I'm glad to see that Jeff passed House Joint Memorial 9 urging the President to end the war after passing House Resolution 2 in 2003 urging the President to go to war.

Merkley was opposed to the Iraq War from the very beginning. Jeff Merkley gave a speech on the House floor saying that he did not believe that Saddam was a significant threat and that going into Iraq was not a good use of our resources. He voted for the non-binding resolution that stated support for the troops while they were at war but did not support the actual invasion. There is a difference IMO.

Kudos to the Oregon Dem Party and to Merkley. It's about there were some Dems willing to push the envelope on campaign finance laws. It's not like the GOP are going to conform to the letter and the spirit of the law. So why go into a gun fight with a celery stick?

This is a close call. IANAL, but the ad doesn't mention his opponent or that Merkley is running for senate seat. It's generic enough that they might just clear the hurdle. This time.

It opens the door to the RNC using their huge financial advantage over the DNC to air ads starring McCain. Bad move.

Worse move: Explaining it with "It's not a coordinated expenditure, it's an expenditure that's coordinated." Read that sentence and explain to me why any voter shouldn't laugh in Matt Canter's face? Fire that clown and get a better spin meister.

It's like saying I didn't shoot him your honor, my gun shot him, I simply pulled the trigger." That's just stupid.

it pushes the envelope but..

1. doesn't say "voter for Merkley"
2. sticks to the veterans benefit issues
3. advocates support for legislation, not Merkeley.

sarahlane - best wishes for the campaign. You still have an uphill battle, but can do it.
