Leahy Against Mukasey
CNN has just reported that Senate Patrick Leahy (D-VT), chairman of the Judiciary Committee, will vote against Michael Mukasey.
"No American should need a classified briefing to determine whether waterboarding is torture," said Leahy, according to the Associated Press. According to a Leahy aide, he's scheduled a presser for 3 P.M. to discuss his opposition.

I sincerely pray this report about Leahy is true. We have to wait until 3 PM to hear his actual press conference. If true, Leahy's decision, combined with McCain slamming Republican pres. candidates for failing to admit that waterboarding is torture and illegal (click Fractal) should leave no honorable alternative for any Senator, let alone Dems on the Judiciary Committee, except to denounce and vote NO on Mukasey.
To maintain minimal levels of Dem party loyalty, it would be outrageous for any Dem Senator on the Judiciary Committee to defy their chairman and confirm Mukasey. There must be consequences for any Dem Senator who cuts a disgusting deal with the White House on Mukasey.
The Committee must be allowed to decide this. I could be wrong, but I don't remember the GOP ever allowing Clinton nominees to reach the floor if they were voted down in committee. Indeed, the GOP committees usually just bottled up the nominations so they never reached the floor, esp. for judicial nominations.

If Schumer decides to eff over all the rest by voting "yes", it will mark a very dark day in Demworld. Demonstrative cohesiveness is what they need to project; Schumer HAS to vote "nay" on this.

Dem Senators not on the Judiciary Committee probably feel (correctly) that they need not take a position because the committee chair (and presumably all the Dem members) will oppose Mukasey, and Sen. Harry Reid will not permit the nomination to reach the floor.
Contrariwise, GOP Senators not on the Judiciary Committee probably feel free to take the posture of supporting Mukasey, because they realize (correctly, I hope) that the nomination will not reach the floor and they will not be forced to actually vote for an AG who will not hold the White House subject to U.S. criminal law.

I'm disappointed that it's taking all the democratic senators so long to make up their minds whether or not to confirm Mukasey. If Mukasey is unable to make a decision on whether current perceived methods of waterboarding are illegal or not then it should be a no-brainer. There must be some official definition of waterboarding that the military historically used to define. C'mon! When given the chance to Stand for something, will Dems stand united? Will the Dems walk all over the Geneva Conventions or will they respect the Dignity that we Americans can claim that our government does not torture. Because right now, Bush, Gonzales, Rumsfeld,etc they all have given orders that torture is a legal standing position which the world looks in disbelief at us. There's not enough images that Karen Hughes can produce showing american children with puppies in white picket fenced neighborhoods to sugar coat this issue in the eyes of the world.

Can someone who knows more than I do tell me if I should be calling Judd Gregg's office yet?
If the committee doesn't vote this guy out of committee, doesn't that mean it won't come to the floor for a vote?
Also, I'm a little concerned about Webb myself, so again, is this just a matter of not saying anything unless it comes out of committee?
In addition, I also can't understand McCain on this. He is loudly against torture, which IS waterboarding and he knows it. So, any ideas where he's coming from on this with the yes vote?
Thanks for any information.
Personally, I sort of think they all (R and D) should have decided not to consider this guy the minute Bush threatened yesterday that it was him or no one.

Reid and Leahy have indicated that the committee vote is it (it doesn't necessarily have to be this way, but in this case it will be), so this is all the marbles.
McCain used to be a man of principle, what can one say.
Bush is an excellent poker player, would be nice to see someone nominally as good as him step up to the table.

WOW! I love Feingold and just called his office to see if there was a REASON to his not making a statement.
They(his guy answering the phone) said there was no comment.
I asked if there was some weird reason he hasn't made a stand.
"No comment"
Then, I noticed that FEINgold, FEINstein and Schumer are all Jewish, so I went to AIPAC to see who they are supporting...

Once again, Patrick Leahy makes me proud to call Vermont home. He's a very ethical, methodical, and deliberate man. Now I hope that Schumer comes through and that the Dems FINALLY take a united stand on something meaningful. I also hope that the Bushies who OKed waterboarding and the other Medieval interrogation techniques being practiced in our name are now a bit more worried that they can and will be prosecuted for war crimes.

I'm at a loss to see why there is such excitement about the possibility of Mukasey not getting confirmed? He is probably the best candidate the Dems will get offered and he's certainly much better than the intern AG in there now.
If you think we're ever going to get an AG under Bush who will say on record that waterboarding in torture you're dreaming. If the Dems vote this one down Bush will be as happy as a clam to leave Peter Keisler in there. He probably has an industrial size paper shredder running in his office 24-7. By the time the next candidate gets to the floor you won't be able to prove we even had US attorneys the last 2 years.
I was personally hoping that the Dems would use this opportunity to get some guarantees that certain investigations will continue instead of getting stuck on this lost cause.
Let me be clear waterboarding is torture and I'm waiting for someone of consequence to stand up and make that clear and end this harmful debate but I have to think that Bush's #1 priority in picking an AG candidate was C.Y.A. We are simply not going to get a candidate who will be willing to say what Bush has already done and likely is currently doing is illegal.
I'm hoping he gets beaten up a bit but gets through so maby we can start rebuilding the DOJ a little.

You forgot about Glenn Fine, though. The DOJ IG. He's got hound dogs watching every shredder in the building. That's assuming he lets anyone have a shredder.
I agree with you that Mukasey was just a C.Y.A. appointment.
I think you might be missing a big point, though: accepting Mukasey's evasions about whether the President is subject to the Constitution and laws would be intolerable, completely unacceptable. Whoever is Acting AG has not sought Congressional approval of that Addingtonesque claim, did he?
We can't let the Senate just wash its hands by saying "they are ALL criminals in the current administration, so who cares if we add one more to the gang."

If you oppose Mukasey. Don't just post your comments here.
If you oppose Mukasey contact your Senators NOW. Contact the members of the Judiciary Committee NOW.
Email, telephone, repeat until they agree.
Do Something positive.
Contact your Senators Now and let them know you don't want torture legalized in America. Vote Against Mukasey's confirmation.

CNN coverage is building and widening, including interviews of Kennedy reminding that waterboarding has been illegal since World War II, quotes from Human Rights Watch, concludig that waterboarding "is specifically banned in U.S. law governing the treatment of prisoners by the U.S. military."

I will not hope anything. I will not condone the legalization of torture. I will not be party to the desecration of our societal morality. I will not accede to the dimunition of our Liberty.

Good for Leahy, but this doesn't look that great to me. You have to believe that of that list, every single one of the listed undecideds is going to join the no ranks. The Dems have NEVER been that cohesive.

Thanks Diane....you are my Senator but I've pretty much joined the club that agrees you have come to stand for nothing progressive.
Schumer I could faintly understand...he made the mistake of a rookie politician and came out in favor so early...in fact offering him up to Bush...that he couldn't back down...or felt he couldn't.
There's only one solution long term....keep working for progressive candidates who are willing to stand for something. We put some good ones in...next round we need to keep working at getting the hacks out.
