Breaking: Despite Decision, Larry Craig Says He'll Stay In The Senate!
It can't be true -- and yet it is. Larry Craig just issued a statement saying that despite a judge's decision today to deny his request to withdraw his guilty plea, he's nonetheless going to stay in the Senate:
"I am extremely disappointed with the ruling issued today. I am innocent of the charges against me. I continue to work with my legal team to explore my additional legal options."I will continue to serve Idaho in the United States Senate, and there are several reasons for that. As I continued to work for Idaho over the past three weeks here in the Senate, I have seen that it is possible for me to work here effectively.
"Over the course of my three terms in the Senate and five terms in the House, I have accumulated seniority and important committee assignments that are valuable to Idaho, not the least of which are my seats on the Appropriations Committee, the Energy and Natural Resources Committee and the Veterans' Affairs Committee. A replacement would be highly unlikely to obtain these posts.
"In addition, I will continue my effort to clear my name in the Senate Ethics Committee -- something that is not possible if I am not serving in the Senate.
"When my term has expired, I will retire and not seek reelection. I hope this provides the certainty Idaho needs and deserves."
So, his reasons for staying are (1) he says he realizes he can still be effective; (2) he would be letting down Idaho to deny them his continued service and experience; and (3) he can't clear his name unless he stays.
Political impact: Because he says he's not running for reelection, the seat is likely to stay in GOP hands due to the tilt of the state. But Craig's decision to stay will infuriate GOP leaders who have been pressuring him to go, because it will keep the story front and center in the news. Indeed, according to CNN, GOP leaders abruptly canceled a press conference they had scheduled for today.
Craig's decision today goes counter to not one, but two previous promises: First, his announced intention to resign by Sept. 30; and second, his office's assertion that if his request to withdraw the plea were denied, he'd step down.

Innocent, even after being adjudged guilty. It is a wonderful example of poetic justice that someone who believes that the accused (at least when they are not white, god fearing Christians)have no rights is trapped in this stall.
He may well be letting down Iowa, but his constituents are in Idaho.

On principle, it's the right decision. It wasn't a big enough offense to resign or face expulsion over.
On politics, it's the right decision. Probably saves the seat for his party, and probably doesn't cost them any, and might provide a key vote somewhere along the line.
For sheer entertainment value, it's the right decision ... though we can only wish the judge had let him go back for his day in court.

Apparently, I would also observe, that it is in fact the Senator who needs to be frequently serviced—even during a short layover in Minneapolis—and not his constituents that require his continued service. I doubt that it gets much better than this…

It's awful for the Republican party. They not only have him hanging around their necks like an albatross, but they are losing the chance to hand pick an interim Republican Senator who could then sail through the 2008 election as a short term incumbent. Now, the people of Idaho get to start from scratch.

Smirk and sneer all you like, but every minute our gay brother stays in the Senate to the mortification of his respectable virtuous Republican colleagues, the chances of Democrat Larry LaRocco, running for the Senate in 2008, IMPROVE. Idaho may be going the way of Montana. Last year a progressive Democrat ran a very good race for the House seat in ID-1, against the ever-poisonous Sali. We live in hope.
And anyway, there's that little Article I, Section 8 (I think) in the Constitution that says that all members of the Congress either on the floor or in transit to their Congressional duties may not be arrested for anything except, I think, treason and high crimes and breach of the peace. I don't have the text handy, but it's like that. Check it.
I'm not sure what breach of the peace covers, but reaching under the stall divider while maintaining a wide stance probably doesn't make it. And Senator Craig was enroute from Idaho to Washington when he stopped off for some bathroom excitement in Minneapolis - and he did cast a vote in the Senate later that day.

They didn't arrest and detain him. That's the point of the provision- that a member of the Congress shouldn't be detained so as to keep him or her from voting. That didn't happen. They let him go and he went on his merry way to vote.
The provision surely doen't mean that a member of the Congress can do whatever he likes on his trip to the Senate floor...

Isn't it about time for someone who Sen. Craig successfully hooked up with in that same restroom to come forward (sorry, no pun intended) and reveal the lurid details? It was probably not Mr. Craig's first rodeo, if the Twin Cities airport was a usual waypoint between his office in DC and Boise.

Craig won't be able to salvage his reputation. He's already a punchline, he's guilty, and he's radioactive. Nobody seems to want him to stick around, save Arlen Specter, and when you're taking advice from the Specter you should know you're in trouble. That guy, always talking about lofty things like due process and habeas corpus, but as soon as Cheney descends from on high he votes the party line.
Ultimately, though, it doesn't really benefit Craig to resign. He still gets to collect a paycheck, he still gets to be a Senator, he still gets to send mail without stamps. The commenters here who mention the RNC in Minneapolis next year are right on the money--Leno's writers are probably writing those jokes now. The big loser in this is the Republican Party, of course, but they really don't have any leverage to use against the guy to get him to quit if he ain't running again.

It could be argued that his statements had the force of a binding contract, and that to be so PUBLIC about it, that is how he could be forced out, he would be showing his intention to engage in a process of defending the value of his given word and the statements which he claims were the result of panic, but the now of his word?
That is fair game and thats the torpedo that sinks his boat.
