Hillary: I'll Crack Down On Mortgage Predators

With the mortgage market a mess, Hillary proposes a crackdown on lending abuses and suggests upping financial aide to families who are about to lose their homes.

In the purely political sense, this is classic Clintonism -- using smart government to target problems that afflict ordinary people and don't come freighted with any ideological baggage, presenting herself as the race's real problem solver, and weaving it into a larger argument about strengthening the economy. Also, it suggests that the housing crisis will soon become a big issue in Campaign 2008.

Presentation is nice, but where's the beef?  Predator lending is an old issue. How about Hillary provide some evidence of what she has done on this issue for the past 6 years in the Senate?  Hillary is good for jumping on the bandwagon of hot issues but she does not have a track record of actual doing anything. She is all talk.

I have long thought that we need stronger consumer protections in lending (including mortgages, payday loans, credit cards, etc.).

While it might not have the baggage of other issues like, say, health care, presumably her suggestion does go against GOP ideology to suggest either cracking down on lenders (anti-big business, gov't paternalism) or bail out those losing their homes (gov't handouts instead of personal responsibility, tax and spend).

Regardless, I think it's a good issue for Dems.

Sub-prime lending is only a small portion of our economy's problems. Private equity firms moving $1.2 TRILLION overseas; international oil revenues moving to petrodollars rather than USD; state-run investment pools are moving to property holdings rather than foreign money; mutual funds and pension funds (totally over $20 TRILLION) have significantly raided their overseas allocation.

All of these affect the dollar, in relation to other currencies.

However, all of these have been affecting the dollar over the past 5-6 years; whereas the sub-prime mortgage issue has only been brought to light for the past couple years.

Was she in the position to introduce consumer lending legislation?

It is all about choices.

She was able to become the Senate chair for the India caucus and enable them to outsource jobs. She is able to boast about how she has represented India so well that she could easily win elections there. During that time she was representing them, predator lenders were busy robbing American citizens of their savings and dream of owning a home.

 Hillary Clinton based on her national stature as a former first lady and spouse of a President is able to advocate on a national level for whatever issue she believes Americans need more help on.  She did not take a leadership role on this issue.

She is the candidate running on experience. Where is her track record on this issue. What has she done? Point me to her leadership on this issue. What legislation has she co-sponsored to help consumers with mortgages. I am tired of her Johnny come lately memes. Where's the beef?

She chose to become the Chair of the Senate Caucus for India instead.. She gets lots of credit for that from Indian immigrants. Her upstate NY constituents find that she failed them by bringing in TATO and supporting more working Visas for immigrants to take their jobs or them to be outsource.

 It is not me that is presenting her actions as cynical rather it is her deeds which demonstrate her cynicism and political expediency when it comes to Americans, their jobs, their dream homes and most importantly their lives.

I think the better approach is to pressure lenders into renegotiating the terms of subprime loans. The bottom-line costs here need to be borne by the lenders, not by the public paying an indirect bailout.

Can anyone tell us how much money Hillary has received from the banking and mortgage industry? Let's all recall, she represents all Americans and lobbyists for those corporate industrys are just Americans like the rest of us...who good ol equal access Hill represents.

That line about lobbyists is as memorable as the one where she has no regrets about sending Americans to die by giving Bush the authority to wage war. Good 'ol equal access Hill.

But how do you propose to do that?

The "lenders" are bond holders (MBS) who have no relation whatsoever with the mortgagors. Those bond holders are looking to third-party credit risk insurers to make them whole and they can't go to those third-party insurers until they suffer a loss (namely, the default and foreclosure of the underlying mortgage).

We're not talking about your neighborhood bank, here.

I am asking Hillary for the deeds that support her words. That is a more than reasonable response to a candidate who is running on experience.

Where is her experience on the issues? What has she done?  She is the one claiming that lobbyists money does not influence where she stands on issues. If that is so she should be able to produce a very impressive record based on experience. If she has so much experience where is it at? How has she been an effective Senator. What issues did she championed on behalf of Americans when she was First Lady. What has she taken a stand on and been an advocated for that produced change?  Her new slogan is she is the candidate 'with experience for change'.  Where are the changes?

I seem to remember a discussion a few weeks back in the Cafe about this issue and it was suggested that part of the problem also seems to be that these debts are being sold to third parties. When this is done it throws a wrench into the lender-borrower relationships/agreements and removes the lender (the party likely willing to renegotiate the terms) from the equation. I am no expert in economics but this seems like it would make things more difficult to get a handle on.

There are certainly predatory lenders out there. The entire industry certainly needs reform and at least some modest attempt at oversight. But isn't the problem much much bigger and more complex then simply going after a few token sketchy lenders? I'm a bit inclined to include financial services onto my list of "public services" that I feel should privatized institution but rather strictly regulated. My rational is that these public services (including electricity, water, health care, etc.) are vital to our citizen's and nation's well being and should not be turned into capitalistic feeding frenzies. The "market" has proven time and again that it is a terrible custodian to the public well being. And while I do appreciate candidates talking about issues (for a change) I hope this isn't another example of election cycle rhetoric where they throw the more (more) or the word (less) in front of an issue and that's about all we get.

Yeah, the problem is not some loan officer in a strip mall real estate office. The problem is that lenders used to negotiate with their borrowers when they got into trouble. Now, they can't because lenders sell the loans to institutional investors and those loans are often sold on terms that don't allow for changes in the loan terms. It's understandable since the hedge fund or pension fund that buys the loan wants the 12$ they signed up for, not a negotiated 8%. But, that is the problem -- A huge, unregulated secondary mortgage market.

I am wary of people trying to attack Obama rather than produce substantive legislation or facts that support Hillary. That is a diversionary tactic to shift the focus from Hillary's lack of accomoplisments and leadership on any issue.

Hillary was not concerned about preditory lending when she voted for the notorious 2001 Banruptcy Bill.

That's the legislation written by the credit card companies that has permitted lenders to escalate interest rates to outrageous, usuary-levels for average consumers. It has produced huge interest-rate hikes and penalaties for minor infractons in lender agreements that are so complex, lawyers cannot even sort them out.

I was referring to the more recent bankruptcy bill, which she voted against in 2005. Remember, it was the one that Josh tried to lead a charge against? And Lieberman voted for cloture but then voted against the bill knowing the Republicans would pass it anyway. It was frought of drama.

Might be helpful if you considered who Hillary is looking out for and who is paying her bills.

It isn't the people about to become homeless who probably shouldn't be over their heads in debt in the first place. Hell, destor, they aren't even middle class but mostly working stiffs.

Remember too Hillary has promised, girl scout's honor, to stiff her backers too. :-) Bet she won't.

This is exactly right. It's just like the stupid idea of getting to universal health care by paying the insurance companies whatever they ask to cover those currently uninsured.

There is the obvious problem that the predatory borrowers have already packaged the loans and sold them to a bunch of poor suckers out in the general market, but that won't be helped by simply throwing money at the predatory lenders. For that you need a) a salutary lesson that when someone offers you returns that look too good to be true, they are, and b) thorough investigation of the disclosures made when those securities were sold, so that people who were deceived when they purchased (shares of) the predatory loan packages can put the liability back where it belongs.

Oh, yeah, and real bankruptcy reform so that getting 60 days behind in your payments never means losing your house...

She and Bill got hugely criticized in 1999 for their sweetheart $1.35 million deal with Terry McAuliffe to guarantee a mortgage for the purchase of their Chappaqua, N.Y. home. Ethics alarms went wild. Bill Clinton was still a sitting president, and many felt the guarantee constituted a major gift and conflict. Hillary, however, was desperate to purchase property (at that time well beyond their means) in New York (and spend time out of the White House) so she could establish residency to run for the Senate in 2000.

See this is what I mean. I asked what Hillary has done. What I get are statements. Nothing but talk as usual.

I am telling you folks, Hillary talks a good game. She beleives that the average person can not discern the difference between words and deeds. I want to know what she has done not what she said. She has said a lot of stuff. I want her track record of accomplishment. Not a litany of statements from the Senate floor or before any committees.  Where is the beef?

But, pray tell, I do remember that the past 6 years have been difficult for any Democrats to get much of anything accomplished.

I think you are confusing "action" with "motion." What does a long list generated by her press office prove? Anyone can logon to Clinton's website (or any politician's) to see the PR. How many of these did she author and introduce as opposed to just signing on co-sponsor in a PR move? How many are serious efforts with real follow up? How many are under serious consideration by committees currently? How many have become law? Leadership isn't just generating paper and claiming credit.

Honestly, you shouldn't have had to have gone through compiling that.

No matter what stance Hillary takes, her detractors will ask why she didn't solve the problem already in the Senate. The very question is so misplaced that it defies answer. Of course, you did the research, posted this and the immediate reply was that a long list is meaningless.

This isn't an argument that can be won because most of the candidates with Senate experience have spent the vast majority of their time in the minority, and with a hostile president.

Maybe this question could be answered with Dodd, who has been in the Senate for a long time.

But everyone is harping on what Hillary has accomplished during a senate run in which very few Democratic senators accomplished anything. Obama's record as a senator is no better than Hillary's. Edward's isn't either. So I choose to have this debate on other issues such as, what are they advocating now?

I understand that some will argue that what Hillary says now hasn't been backed up by past deeds. I'll have that debate. But the weird thing about the current argument is that if Hillary were able to perform to the level that her detractors demand, she wouldn't bring up any issues because she'd have already solved them as a Senator. She would then be running on a platform of maintaining the Utopia that she created. This is, of course, an impossible standard.

It did take a couple of hours. I did it because I think they are asking a legitimate question. With this list I hope that a neutral observer would clearly see that the caracature of Clinton that so many of the posters here keep pushing, is nonsense.

btw each line above is a separate bill sponsored or co-sponsored by Clinton. In many cases the other co-sponsors are mentioned. I had to winnow down the ~400 "statements" to the 68 representing separate bills. (Surely I made a few errors or repititions.) I eliminated other important items like "Statement of Senator Clinton on Supreme Court's Gonzales v. Carhart Decision" because, well, that's just talk.

I live in Western New York and I believe that she has been a very effective Senator, but now, I'd say, this is proof.

It's a legitimate question but not an honest one. That's my blunt assessment, and I hate to be blunt about other people on this board. You provide the list, they'll ask which became law. If you provided a list of bills that became law, they'd ask you to document the positive effects of those laws. It's never ending. And, the questions don't seem to apply to anyone but Hillary in this dicussion, so far.

Sure some will make up endless lies about a possible dem nom for president. But I like the push back. And it did not hurt the listmaker and in fact the listmaker gained better understanding of what a possible dem nom for president is up to. I did to.

But there's a big problem developing here... Obama's supporters are messianic -- they ask questions of Hillary that they would not dare to have asked of Obama, they tell us Hillary can't be elected in the general in spite of the hurdles Obama would have to leap, and they speak to those of us who haven't settled on Obama as the nominee as if we are apostates.

I'm not for Hillary at this point. But I am dead set against holding Hillary to prophetic standards that she can't meet, that Edwards can't meet, and that Obama can't meet.

The Obama supporters, through sheer volume of posts, by down-rating other comments and by ganging up on other commenters here are attempting to impose their will. It makes me loathe both Obama and his supporters.

Hillary claims vast "experience" and no influence by corporate lobbyists. She should be held directly acountable for those statements, if she is the most qualiied to be president. What makes her better, not just the same?

But, Hillary is claiming "prophetic standards that she can't meet"! Holding her accountable for those claims is a responsiblity of citizenship. She claims she has vast "experience" and is the most qualified person in the nation to be president based on her RECORD. Where's the substance behind that claim? I don't think hollow rhetotic and co-sponsored, symbolic, dead-end legislation is evidence of extraordinary qualities of policy insight and leadership.

And Hillary, the empassioned expert on healthcare reform? Oops, no concrete substantive proproposal, just elevated rhetoric. She has promised "universal healthcare by the end of my second term." High priority? Maybe we will see Hillary's plan when the healthcare lobbyists have maxed out their campaign contributions, or maybe Hillary's obligation to them is just to be silent on healthcare specifics, until her "second term."

How do you know the rhetoric is hollow? How do you know the legislation is symbolic (fake?) and not an expression of her true aspirations? Oh, yes, you just know it in your heart.

C'mon Destor...messianic?  No, it is more like TeamHillary is Hillaryland..like Disney...they think if they can distract with the thrills of a ride you will not see the truth and that Hillary has no substance. Her followers are like sheep.

If folks who are pro-Obama state why they are, folks like you distort, misrepresent and mischaracterized what Obama says. We are democrats and the polls show that 50% of Democrats are not willing to vote for Hillary. We are democrats not republicans. That should tell you why she is unelectable right there. Her own party base is unwilling to vote for her. That is relevant and a serious issue. Hillary does not appeal across party lines and she is not appealing to independents either.

There have been no questions asked of Hillary that folks are unwilling to ask Obama. The truth is just the opposite. Hillary is the one who will not disclose her earmarks, Obama has..Hillary is the one who refuses to provide a universal health plan..Obama has. Hillary is the one who does not regret her vote on Iraq...Obama opposed the war from jump. Obama is the one with a FP plan...not Hillary.

So on two of the most significant issues for this election...universal health care and the war...Hillary does not agree with the majority of the Democratic party. That is an big problem.

What seems to be the case is that individuals who believe Hillary should be the nominee are unable to refute or rebut the very real facts that Hillary is wrong on the primary issues.  She is wrong on healthcare, wrong on foreign policy and wrong about the war.

I challenge you to show how and when Obama has not addressed these issues.

More importantly, I hope that you understand that by not discussing Obama in this thread I provided Hillary supporters every opportunity to show why Hillary based on her track record should be the nominee.

They couldn't. She has no track record of leadership or accomplishment despite all the 'experience' her supporters claim she has. All they pointed to was talk,talk talk. No track record of anything

I believe this was a fair question and that it was unbiased to focus on Hillary alone.

The reason you see a lot of Obama supporters is because we are the voices who want change. We are unwilling to accept the status quo.

We are no different from what is happening nationally. Obama is not drawing crowds because he is a rock star, but because he is rock solid. Folks understand that they can no longer listen to nor follow those people who are responsible for the horrible mess this country is in. The 'experts' were WRONG and they continue to be WRONG and the media continues to tout them as experts.  Well, if that is the experience we should rely on...we are stupid to listen to them.

I want change and Hillary is the status quo. 

Sorry if the sheer volume of support Obama gets bothers you but you might want to go to other liberal sites and you will see that it is the same. The Democratic base by and large is not supporting Hillary for the nominee.

We want CHANGE. We refuse to be SHEEPle for Hillary.
